*** TERMS OF SERVICE & STORE POLICIES ***


PLEASE READ CAREFULLY: By purchasing from Paintball Store Inc., you agree to the following terms. These policies strictly enforce liability regarding paint breakage, age restrictions, and returns.

  1. PAINT & SHIPPING LIABILITY
    We inspect every case of paint before shipping to ensure it leaves our facility in perfect condition. However, shipping carriers can be rough. We do NOT accept returns or offer refunds for paintballs broken in transit. By purchasing paint, you accept this risk.
  2. AGE VERIFICATION
    By placing an order for any paintball marker or air tank, you certify that you are at least 18 years of age. Paintball Store Inc. is not responsible for injury or damage resulting from the misuse of these products or use by minors without adult supervision.
  3. FRAUD PREVENTION & SHIPPING ADDRESSES
    To protect our customers, orders over $200 may be subject to verification. For first-time customers, we reserve the right to ship ONLY to the billing address associated with the credit card. If your shipping address does not match your billing address, your order may be delayed or cancelled.
  4. RETURNS & RESTOCKING FEES
    Returns are accepted on NEW, UNOPENED items within 14 days of delivery.
  • Once a marker has been fired or paint has been run through it, it is considered USED and cannot be returned for a full refund.
  • Used/Open items that are not defective may be rejected or subject to a minimum 15% restocking fee.
  • Defective items are covered by the manufacturer’s warranty. Please contact the manufacturer directly for repairs.

LOCAL PICKUP
Orders placed for Local Pickup at our Aldine Meadows location must be picked up by the cardholder. You must present a valid photo ID and the credit card used for the purchase upon pickup.

5. INTELLECTUAL PROPERTY

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Paintball Store Inc. or its content suppliers and protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Paintball Store Inc.

  1. TRADEMARKS

“Paintball Store Inc.”, “Survival Game of Texas”, and other marks indicated on our site are trademarks of Paintball Store Inc. in the United States and other countries. All other trademarks not owned by Paintball Store Inc. that appear on this site are the property of their respective owners.

  1. LIMITATION OF LIABILITY

PAINTBALL STORE INC. SHALL NOT BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE OR THE PERFORMANCE OF THE PRODUCTS, EVEN IF PAINTBALL STORE INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

  1. TYPOGRAPHICAL ERRORS

In the event that a Paintball Store Inc. product is mistakenly listed at an incorrect price, Paintball Store Inc. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. We reserve the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Paintball Store Inc. shall issue a credit to your credit card account in the amount of the incorrect price.

  1. GOVERNING LAW

Your use of this site shall be governed in all respects by the laws of the state of Texas, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Paintball Store Inc. products) shall be in the state or federal courts located in Harris County, Texas.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Paintball Store Inc., its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
